قد يرد النهي عن الأفعال وقد يرد عن الأقوال ،فإن كان عن الفعل فهو إما أن يرد على ذات الفعل؛ كالسرقة وشرب الخمر والزنى ، أو عن جزء الفعل كالسجود لغير الله ، أو وصف لازم للفعل قد ينفك عنه كالصلاة في الثوب المغصوب أو الأرض المغصوبة ، أو عن وصف لازم للفعل ولا ينفك عنه كصوم يوم العيد ، ولا خلاف بين الأصوليين أنه إن ورد عن ذات الفعل أو جزئه فيفيد البطلان ، وإن ورد عن الوصف فهو يفيد الفساد عند الحنفية ، والبطلان عند الجمهور ، إذ هو لا يفرقون بين الفساد والبطلان ، وفرّق الحنفيةُ بينهما .
