تغيير الإسلام للمناهج لتي كانت متبعة ومتناقضة في التوارث عند الأمم الماضية . لا ميراث قبل موت المالك . وأركان الميراث : المورث : ويجب تحقق موت المورث حقيقة أو حكماً . والوارث : وهو من يستحق نصيباً من المال الموروث ، ومن لا وارث له من قريب أو زوج أو موالاة فإن الدولة هي جهة استحقاق المال ، لأن الإسلام لا يسمح بأن يكون المال سائباً بلا مالك . والمال الموروث يشترط للتوارث : التحقق من موت المورث ، والتيقن من حياة الوارث قبل موت المورث ، ووجود سبب التوارث بين المورث والوارث ، والسبب : قرابة أو عقد زوجية أو ولاء.
